This Terms of Service Agreement ("Agreement") is between you and GramScraper ("GramScraper", "we", "us" or "our"). This Agreement takes effect when you use https://gramscraper.com (the "Site") or accept it electronically.
These Terms govern the Site and GramScraper's API and dashboard (the "Services"). By using the Services, you agree to these Terms, our Privacy Policy, Acceptable Use Policy, Data & Privacy notice, and Refund Policy.
We may change this Agreement and incorporated policies by posting the revised version on the Site. Your continued use after a change takes effect constitutes acceptance of the revised terms.

GramScraper is an independent service and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., Instagram, or any other third-party platform referenced on the Site. Any trademarks or platform names mentioned are the property of their respective owners and are used only to describe the data the Services can access.
You must be at least 18 years old to create an account with GramScraper. You are responsible for all actions taken under your account.
Visiting the Site doesn't require an account. However, to fully use our Services, registration is mandatory. Ensure that the information you provide during registration is accurate and complete. Do not use an invalid or someone else's email, as it compromises your account's security.

The Acceptable Use Policy is part of these Terms. We may review use patterns, apply rate limits, conduct use-case reviews, suspend API keys, or terminate accounts where reasonably necessary to investigate or stop abuse.

You may use the Services only for lawful access to publicly available data. You are responsible for confirming that each use case and downstream use complies with applicable law, platform terms, and the rights of data subjects and third parties.

GramScraper is not responsible for how you use the Services. We can't be held accountable for any damage, loss, or conflict arising from or related to your use of the Services.
The Services, including all data returned through the API, are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. We do not warrant that the data returned will be accurate, complete, or fit for any particular purpose, and we do not warrant that the Services will be uninterrupted or error-free.
To the extent permitted by applicable law, GramScraper will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or loss of business — arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, GramScraper's total liability to you for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid GramScraper in the 12 months preceding the event giving rise to the claim.
The Services depend on third-party platforms, including Instagram, that GramScraper does not control. These platforms may change, restrict, or block access at any time and without notice. GramScraper does not guarantee continuous availability of any specific endpoint, data field, or dataset, and is not liable for disruptions caused by changes to a third-party platform. GramScraper operates on a one-time credit purchase model. There are no subscriptions or recurring charges. Credits never expire and remain in your account until used. If purchases are available, the payment provider and applicable checkout terms will be shown before payment. By making a purchase, you agree to the pricing and credit allocation displayed at checkout.
Refunds may be issued for duplicate charges, significant service unavailability, or technical errors where credits were not delivered. Used credits are not eligible for refund. We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service.
Upon termination, Your right to use the Services will cease immediately.
To the extent permitted by applicable law, you agree to indemnify and hold harmless GramScraper and people acting on its behalf from third-party claims, reasonable costs and losses arising from your unlawful use of the Service, your material breach of these Terms, or your infringement of another person's rights.
Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.
The Services can be accessed from countries around the world and may contain references to Services and Content that are not available in your country. These references do not imply that GramScraper intends to announce such Services or Content in your country.
Those who access or use the Services from other countries do so at their own volition and are responsible for compliance with local law.
If you have a concern or dispute about the Services, please first try to resolve it informally by contacting GramScraper.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Subject to any mandatory rights or forum available to you under applicable law, disputes that cannot be resolved informally will be subject to the courts of competent jurisdiction in the State of Delaware, USA.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Services after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Services.
